Butterpie, LLC and ButterpieGPT, LLC are referred to together as “Butterpie,” “we,” “us,” or “our.” By using our Services, you agree to this Privacy Policy and our Terms of Use. 2. Information we collect

2.1 Information you provide

• Account and profile. Name, email, password, phone, photo or avatar, timezone, language, company name, creator or business details.

• Creator program. Connected social handles, audience insights, product interests, integrations you authorize, submitted forms, collaborations, and brand preferences.

• Content and uploads. Text prompts, messages, documents, images, audio, video, datasets, metadata, annotations, feedback, bug reports.

• Transactions. Billing name, address, tax details, plan type, purchase history.

• Payment. Cardholder data is processed by our payment processor. We receive limited payment metadata and status.

• Identity checks. If required for fraud prevention or legal compliance, we may collect IDs, selfies, or government numbers through a verification vendor.

• Support. Emails, chat transcripts, call recordings, and survey responses.

2.2 Information collected automatically

• Usage. Feature use, pages viewed, buttons clicked, prompts length and frequency, session duration, referral pages.

• Device. Browser type, device model, operating system, app version, IP address, general location derived from IP, cookie IDs, advertising IDs.

• Logs. System events, error logs, diagnostics, performance metrics, and security telemetry.

2.3 Information from third parties

• Integrations you connect. Social platforms, ecommerce, analytics, ad networks, CRM, data warehouses. We receive only the scopes you authorize.

• Partners and service providers. Fraud, security, enrichment, or analytics information.

• Public sources. Public social profiles, public web pages, and open datasets for validation and safety.

2.4 Sensitive personal information

We do not seek to collect sensitive information such as precise geolocation, health data, or biometric identifiers. If you choose to provide sensitive information, you consent to our processing for the purposes described in this policy. If we must collect sensitive data for verification or compliance, we will limit use to that purpose and apply stricter safeguards.

 

3. How we use information

3.1 AI training and model improvement

• Your inputs and outputs are processed to provide the Services you request.

• We do not use your private content to train third party foundation models.

• We may use your content to improve Butterpie models and quality by default in a privacy preserving way. You can opt out at any time. Opt out methods are in Section 10.

• We de-identify training records where feasible and apply access controls, retention limits, and audit trails.

3.2 Automated decision making

We use automated systems for safety, abuse detection, personalization, and feature performance. You can request information about these systems or opt out of targeted personalization where required by law.

 

4. Legal bases for processing under GDPR and UK GDPR

• Contract. To provide and support the Services you request.

• Legitimate interests. To secure, improve, and market the Services in ways that do not override your rights.

• Consent. For cookies, certain analytics and marketing, and optional AI improvement where required.

• Legal obligation. To comply with laws and protect our users.

 

5. How we share information

We share information with:

• Service providers. Hosting, storage, compute, content delivery, communications, analytics, payments, identity verification, security, and support vendors.

• Integration partners. Only when you connect or instruct us to share with a platform or tool.

7. Data retention

• Account data. For the life of the account, then up to 90 days for backup and audit.

• Content and prompts. Default 24 months unless you delete earlier or opt out of retention. You can set stricter workspace policies.

• Logs and security telemetry. 12 to 24 months.

• Billing and tax records. 7 years or as required by law.

• Legal holds. Until the matter is resolved.

We delete or de-identify data after the retention period.

 

8. Security

We use technical and organizational measures that align with industry standards.

10.3 AI training opt out

You can opt out of product improvement use of your content:

• Or use the in-product privacy controls if available.
  Opt out does not affect data used to provide the Services you request or for safety, security, or legal obligations.

10.4 Regional rights

Your rights depend on your location. We will honor all rights that apply to you.

California, Colorado, Connecticut, Utah, Virginia, and other US state laws

• Right to know, access, and portability.

• Right to delete.

• Right to correct.

• Right to opt out of sale or sharing, targeted advertising, and certain profiling.

• Right to limit the use of sensitive personal information.

• No discrimination for exercising rights.

EEA, UK, and Switzerland

• Right to withdraw consent at any time if processing is based on consent.

• Right to lodge a complaint with your local supervisory authority.

11. Children’s privacy

Our Services are for users 16 and older. We do not knowingly collect personal information from children under 16. If you believe a child provided information, contact info@butterpie.ai and we will delete it.

 

12. Creator and enterprise integrations

If you connect third party accounts or upload audience data:

• You are responsible for having a lawful basis and required disclosures to your audience.

• We act as your processor for that data and will process it only on your documented instructions, subject to our data processing terms.

• Remove integrations at any time in settings. We will stop new data flows and delete previously synchronized data per your retention settings, subject to backups and legal requirements.

 

13. User generated content and community features

Content you submit to public areas may be visible to others. Do not share personal or confidential information in public spaces. We may moderate content for safety and legal compliance.

 

14. Third party sites and services

Links to third party sites are provided for convenience. Their privacy practices are not covered by this policy. Review their policies before you share information.

When enterprise customers supply data about their creators, employees, or end users, we act as a service provider or processor. We process that data only to provide the Services, follow the customer’s instructions, and support compliance with applicable laws. Our data processing terms are available on request.

 

18. Safeguards for AI and safety systems

• Safety filters reduce harmful or illegal content.

• Abuse detection is applied to inputs and outputs to protect users and the platform.

• Human review may occur for abuse investigations, support, or quality. Reviews are restricted, logged, and confidential.

• Do not upload content you do not have the right to use. Do not include personal data of others without permission.
